Susan Artinian has 29 years of experience in medical device and pharmaceutical, commercial and employment litigation defense on behalf of clients from a broad cross-section of industries, including drug and medical device manufacturers, retail and automotive.

She currently serves as National Science and Expert Counsel for the Bayer Corporation in two major mass tort situations and has held a national role in previous mass tort litigation for the company.  Ms. Artinian's team is routinely involved with complex Daubert and other scientific issues, the selection and work up of general and specific medical experts, and extensively involved with expert interrogation and defense.
 
Previously, Ms. Artinian was a member of the National Trial and Expert Development Team for a major breast implant manufacturer.  As part of that team, she was responsible for the preparation of plastic surgery expert testimony for all of the client's implant cases.  The defense team's efforts for this manufacturer resulted in winning 30 of the 33 cases tried, and these victories played a significant role in the eventual decision by thousands of plaintiffs to accept reasonable settlements, and for the controversy to subside.
 
On behalf of one pharmaceutical company, her team determined that nearly half of the pending cases were not bona fide, resulting in a savings for the company of millions of dollars in defense costs.
 
Prior to joining Dykema, Ms. Artinian was the first law clerk to former Chief Judge Julian Abele Cook Jr. of the U.S. District Court for the Eastern District of Michigan, Southern Division.

Experience

  • Defended regulated and non-regulated medical devices, from heart products, prostheses and shunts, to medical machinery, equipment and monitoring systems, to cases involving drugs, biological products and products alleged to have caused toxic torts.
  • Defended all employment litigation brought in Michigan against a major U.S. corporation and its many subsidiaries.
  • Successfully defended sexual discrimination and harassment claims.
  • From 1992 through 1999, she was involved extensively with breast implant litigation in Michigan and throughout the country, and was the elected defense liaison counsel in the state of Michigan where over 2000 separate actions were pending.
  • Supervised the defense of product litigation in jurisdictions outside of Michigan.
