Alex W. Craigie, an employment lawyer in Dykema’s Los Angeles office, was quoted in an article, “Question of Control: Do a franchisor’s actions speak louder than its words?” that appears in the January 2013 issue of Franchise Times.

The article focuses on a high-profile vicarious liability dispute between a nationally known franchisor and one of its franchisees that is currently pending before the California Supreme Court.

Craigie suggests that this case—which is being carefully watched by franchisors nationwide—holds a number of important lessons. He notes that franchisors need to “enhance their training of supervisory employees” and to clarify their positions “by removing all ambiguity about who is responsible for what” in franchise documents and manuals. Otherwise, they might find themselves liable for the actions of their franchisees and/or their employees.
