Joanne R. Lax, a member of Dykema’s Health Care Practice Group, will participate in a panel discussion – “Top 10 Significant Issues in the HIPAA/HITECH Omnibus Rule: An Homage to Letterman” – at a one-day conference that focuses on the legal implications of this new regulation. The conference, part of the series of continuing education programs presented by the American Health Lawyers Association (AHLA), will take place on March 22, 2013 in Baltimore, Maryland.

In a 90-minute interactive session, Lax and her fellow panelists will discuss the implications of key provisions in the HIPAA/HITECH Omnibus Rule, which healthcare providers and counsel alike need to understand. The panel will present an overview of such key issues as:

  • Breach notification;
  • Business associates;
  • Agency relationships;
  • Governmental enforcement activity;
  • Access to ePHI (electronic protected health information);
  • Restrictions of PHI to health plans;
  • Marketing, fundraising and sale of PHI;
  • Research;
  • Notices of privacy practices; and,
  • Security

Each of the panelists will look at the HIPAA/HITECH Omnibus Rule through the eyes of a particular segment of the health care industry. Lax will provide the long term care and post-acute perspective. Other panel participants will present the perspectives of hospitals, physicians and health plans.

Organized by the AHLA, the nation’s largest, nonpartisan, 501(c)(3) educational organization devoted to legal issues in the healthcare field,  this one-day conference is fully accredited, offering between 6.5 and 7.8 CLE credits and 7.0 CPE credits.
