Joanne R. Lax, a member in Dykema’s Health Care Practice Group, will present a paper, “Protection and Advocacy Systems: Self-Proclaimed Caped Crusaders or Strategic Allies,” at the Annual Meeting of LeadingAge Michigan, a nonprofit association that represents the mission-based providers of housing, services and care for seniors across Michigan. This three-day conference will take place in Grand Rapids, Michigan May 20-22, 2013.

In a one-hour session Monday afternoon, May 20, Lax will explore the claimed legal basis for the P&A System to oversee care in skilled nursing facilities; limits on that role; and appropriate facility responses to inquiries from P&A Systems that seek to investigate individual incidents. The Michigan Protection and Advocacy Service (MPAS) is one of the most assertive P&A Systems in the United States, so Michigan skilled nursing facilities need to be prepared to respond appropriately when MPAS inevitably comes knocking.
