Thomas Schehr, Detroit-based member and leader of Dykema’s Financial Services Litigation Practice Group, and Jared Kemper, Minneapolis-based associate in the firm’s Financial Services Litigation Practice Group, co-authored an article entitled, “Trends in HAMP Litigation,” for the Journal of Taxation and Regulation of Financial Institutions.

The article addresses recent developments in litigation involving the Home Affordable Modification Program (HAMP) across the country, highlighting that HAMP litigation has steadily increased since the creation of the program by the Department of the Treasury in 2009. Schehr and Kemp point out that borrowers have alleged a number of creative causes of action under HAMP against mortgage servicers, but most courts have rejected the claims because HAMP does not create a private right of action.
