Deborah D. Williamson, San Antonio-based member in Dykema’s Bankruptcy Practice Group and an American Bankruptcy Institute (ABI) commissioner, was quoted in The Deal Pipeline article, “ABI report suggests debtors have one year to address commercial property leases,” which covers an ABI commission report that suggests that the Chapter 11 process is outdated, costly and needs serious change.

In the article, Williamson points out that the suggestion to give debtors a full year to make decisions on which commercial leases to assume or assign and which to reject make it so the debtor could go through the business cycle but not let the landlords be held hostage. She also explains that the it gives them the chance to look at it on a store-by-store basis for those that faltered because of tactical mistakes, as well as allows the debtor more time to mull over how it might market those leases and shop those assets.
