In recent years, a number of states have established Certified Capital Company (CAPCO) programs to attract investment in emerging businesses into their states. Under such programs, states provide tax credits to insurance companies in exchange for which those companies provide initial seed money for investing in state-domiciled businesses. Dykema has substantial experience representing insurance companies making investments pursuant to CAPCO programs in a number of states.
