Overview

Dykema has extensive national experience representing clients in all areas of real estate finance. Our representation of nearly 40 national, local and foreign banking and other financial institutions as well as borrowers in commercial loan transactions makes us the adviser of choice for both financial institutions and borrowers. Our clients are engaged in all types of complex financing transactions including acquisition and development loans, construction loans, revolving credit loans (both secured and unsecured), syndicated credit facilities, mezzanine loans, affordable housing loans, credit enhancements, bond financings, TIFs and special service districts, debt/equity transactions, workouts and deed-in-lieu of foreclosure transactions. We represent investment funds, and public and private entities in industries ranging from manufacturing to technology to retail. We are known not only for our technical experience, but for our pragmatic approach to solving problems and helping our clients achieve their goals. Our depth of experience in representing both lenders and borrowers allows us to provide more comprehensive value to our clients.

We regularly represent real estate lenders and borrowers in workouts and restructurings of troubled projects. Additionally, we represent rated special servicers of CMBS (commercial mortgage backed securities) portfolios in the resolution of defaulted loans. With extensive experience representing both lenders and borrowers in credit transactions and in bankruptcy proceedings, we can help lenders identify options and strategies that will maximize their recovery in troubled loans.

Our representation of developers is vast and includes advising on acquisition, development, construction and permanent financing transactions for residential projects, including rental and condominium developments, mixed-use projects, hotels, office buildings, industrial parks, factories, shopping centers and retail developments. We assist in structuring the financing for projects, negotiating and drafting the documents for loan and equity transactions, and closing the transactions. Our relationships with a broad range of lender clients are useful to our borrower clients in making connections to obtain financing for their projects.
