Aaron Charfoos, Chicago-based member in the Intellectual Property and Intellectual Property Litigation practice groups, wrote an article that appears in the May 2014 issue of Metropolitan Corporate Counsel, a monthly publication distributed to more than 30,000 top-tier executives (chief legal officers, general counsel) in the law departments of major U.S. companies.

Themed “Stopping the ‘Patent Troll’: Or, What You Need to Know About the Current Litigation to End Abusive Patent Litigation,” the article provides insight into what Charfoos describes as a “dizzying array” of current legislation and executive actions designed to curb the rise in patent litigation by nonpracticing entities (NPEs, also known as “patent trolls”).

Charfoos identifies and provides comprehensive descriptions of the key proposals in various pending legislation. Among them:

  • Cost Shifting Including Attorneys’ Fees
  • Disclosure of the Real Party-in-Interest
  • Curbing “Bad Faith Demand Letters”
  • Expanding the Transitional Program for Covered Business Method Patents Review

Charfoos notes that individually and collectively, the reform efforts on each of these fronts (in addition to other considered initiatives) have the potential not only to “curb abusive patent litigation, but to impact patent litigation generally.”
