Kyle Hauberg and Brian Page Co-Author Article for CoreNet Magazine

Kyle Hauberg and Brian Page, Members of Dykema' s Real Estate and Environmental Department, collaborated on a one-page article—“Potential ‘Green’ Lease Pitfalls”—that appears in the November/December 2013 issue of The Leader, a magazine published for the membership of CoreNet Global, the largest association of corporate real estate and workplace executives in the world.

In the article, Hauberg and Page call attention to the various consequences attached to green lease provisions—those elements that relate to environmentally-friendly guidelines and policies (covering such area as sustainability, recycling, energy efficiency)—that impact legal compliance, use, alterations, casualty and insurance.

Among many tips provided by Hauberg and Page: the need for tenants to be particularly vigilant when examining commercial lease provisions that call for compliance with the landlord’s “sustainability practices,” as they note this term is often “defined very broadly and lacks objective measuring criteria.” The co-authors cite another reason to examine these provisions carefully: the potential for the tenant’s obligation to change over time as the underlying criteria change.
