Rob Boonin Evaluates Department of Labor Ploy in SHRM Overtime Litigation Update

Robert A. Boonin, Detroit and Ann Arbor–based member in Dykema’s Labor & Employment Practice Group, and former chair of the Wage and Hour Defense Institute, was quoted in the Society for Human Resource Management article, “DOJ Abandons Defense of Increased Salary Level in 2016 Overtime Rule.”

In response to the DOL’s withdrawal of its unpopular $47,476 salary threshold for exempt positions while appealing a 2016 court decision decreeing that the Department did not have the power to set salary limits, Boonin warns of the risks of such a maneuver.
