Lou Chronowski, Chicago-based member of Dykema’s Commercial Litigation practice, authored the article—“NLRB Decision Shocks Franchise World: McDonald’s, A ‘Joint Employer’ of Franchisee Employees”— that appears in the October 2014 issue of Metropolitan Corporate Counsel, a monthly publication viewed by nearly 20,000 top-tier executives (chief legal officers, general counsel) in the law departments of major U.S. companies.

In the article, Chronowski discusses the recent announcement by the National Labor Relations Board (NLRB) Office of the General Counsel naming McDonalds, USA, LLC as a joint employer with franchisees if the parties cannot reach settlement in certain cases and complaints are issued. He points out that if this decision is upheld by the NLRB and the courts, it will greatly impact the dynamics of the franchise relationship and the cost of doing business as a franchisor will increase as it faces additional liability as a joint employer of franchisees’ employees.
