Jason T. Hanselman, Lansing-based member in Dykema’s Government Policy & Practice group, was quoted in the Law360 article, “Novel Gaming Tech Stokes Tribal, State Competition.”
The article discusses controversial new gaming technology that has blurred the lines between the different classes of gambling activities Native American tribes can offer, putting tribes at odds with states that are also seeking to profit from the latest innovations. Hanselman points out that some tribes are pushing the envelope with Class II gaming, as well as Class II games on the Internet.
Hanselman also highlights that some states, such as Michigan, complicated the compacting process themselves by creating terminals for state lotteries that resemble slot machines. He stated that tribes have often allowed states the right to conduct lotteries in compact negotiations, the lottery terminals, as well as expanded electronic gaming that allows the lottery to be played on cellphones, poses a more widespread threat to tribal gaming revenues.
