Lea Courington focuses her practice on health care, government investigations and white collar criminal defense, and antitrust matters. She defends physicians, hospitals, health care systems, hospices, and home health care companies and their officers and directors in False Claims Act and qui tam cases and represents them in parallel criminal and civil governmental investigations arising from whistleblower complaints and allegations of Medicare and Medicaid fraud. A former Trial Attorney with the U.S. Department of Justice Antitrust Division, her experience includes both civil cases and the prosecution and defense of white collar federal criminal matters.

Experience

  • Represented targets and witnesses in federal and state grand jury investigations into alleged health care fraud.
  • Represented large metropolitan hospital system in qui tam suit and federal investigation involving allegations of False Claims Act violations due to Medicare/Medicaid fraud.
  • Conducted internal investigations arising from whistleblowers’ allegations of health care fraud.
  • Represented physicians, nurses, dentists, pharmacists and other health care providers before state licensing boards.
  • Represented health care providers in Zone Program Integrity (ZPIC) investigations.
  • Represented physicians, hospitals, medical staff executive committees and their members in medical staff hearings and peer review committee investigations, including acting both as counsel for them and, in other matters, as hearing counsel.
  • Represented physicians who had medical staff privileges suspended because of allegations of Medicare/Medicaid fraud.
  • Obtained summary judgments for hospital and physician defendants on federal antitrust claims.
  • Assisted health care providers in identifying, disclosing, and repaying retained Medicare overpayments.
  • Represented defendants in libel, slander and defamation cases in which they asserted defenses of peer review immunity.
  • Represented national blood bank in cases in which it was alleged recipients of donated blood had contracted transmission-related illnesses, including AIDS and Hepatitis.
  • Represented hospitals in infectious disease outbreak cases and peer review investigations of the outbreaks.
  • Irving Healthcare Systems v. Brooks, 927 S.W.2d 12 (Tex. 1996)
  • Represented defendant chairman of medical peer review committee in case before Texas Supreme Court in which scope of Texas medical peer review immunity statute was broadened, thereby providing expanded protection for the process of improving the quality of patient care.
