Gemma R. Galeoto is an experienced litigator who works with clients to craft solutions to business disputes in all aspects of complex commercial litigation and dispute resolution. Ms. Galeoto’s practice specializes in representing middle-market businesses in all manner of business disputes, contract disputes, bankruptcy claims, fraud, unfair competition, trade secrets, consumer finance disputes, labor and employment litigation, and appellate work. Ms. Galeoto works to obtain efficient and effective resolutions for her clients, tailoring the needs of the client with the applicable remedy in state or federal courts. Ms. Galeoto guides clients from start to finish, including arbitrations, mediations, trial and appellate briefing, and oral argument.

Consistently peer-recognized as one of the top attorneys in Texas, Ms. Galeoto has significant experience advising and defending businesses, as well as financial institutions, in complex litigation matters, including claims under the United States Bankruptcy Code, the Fair Debt Collection Practices Act, the Real Estate Settlement Procedures Act, Truth in Lending Act, the Fair Credit Reporting Act, the False Claims Act, and applicable state-law claims and statutes.

Ms. Galeoto is licensed in Texas, California, Florida and Washington, and brings a broad range of knowledge to craft applicable, and practical, solutions for each client. Not subscribing to a “one-size fits all” methodology, Ms. Galeoto tailors her approach to each client and determines their goals in order to best meet them, whether through litigation, or other dispute resolution tactics.

Ms. Galeoto has successfully resolved many cases pre-trial through motion practice and negotiations, but is not afraid of trial, having served as first chair in both bench and jury trials in state and federal courts. Ms. Galeoto also has experience successfully pursuing and defending appeals in Texas state and federal courts.

Ms. Galeoto earned her Juris Doctor degree, cum laude, from Southern Methodist University, Dedman School of Law, where she was a recipient of the Order of the Barristers National Award and won four moot court competitions, as well as best brief and best advocate awards. She was named the Fred C. Moss Advocate of the Year by the SMU Dedman Board of Advocates. Before law school, Ms. Galeoto graduated summa cum laude from Southern Illinois University, where she competed on the school’s parliamentary debate team.

Experience

  • Counsels business clients of all sizes in resolving disputes before, during, and after litigation
  • Served as lead defense counsel in jury trial in Harris County on a breach of contract dispute, resulting in a directed verdict for client
  • Served as lead counsel in multiple bench trials in Dallas, Harris, Fort Bend, and Travis counties, representing consumer lending clients in breach of contract disputes, obtaining positive bench rulings in each
  • Served as lead trial counsel in bench trial in Callahan County for pro-bono client Humane Society of North Texas, obtaining a judgment removing and protecting 218 animals from cruel treatment
  • Served as lead defense trial counsel in bench trial on a contract dispute in Dallas County, resulting in zero exposure for client
  • Primary drafter of arbitration briefing in Dallas County in a contract dispute for over $700,000, obtaining a win for client at both the arbitration and trial court levels
  • Has conducted over 50 depositions of plaintiffs, other witnesses, corporate representatives, and expert witnesses
  • Represented consumer lending institutions drafting multiple successful motions to dismiss defending against claims for violations of FDCPA, RESPA, TILA and FCRA, obtaining dismissal for client
  • Second-chair counsel in obtaining agreed temporary injunction order in multimillion-dollar labor and employment dispute
  • Drafted successful appellate briefing for consumer lending and business clients in Texas appellate courts and the Fifth Circuit Court of Appeals
  • Obtained temporary restraining order and temporary injunction against fraudulent contractor, leading to settlement for small business client
  • Drafted multiple successful motions for summary judgment in state and federal courts on Texas state and federal allegations, obtaining positive verdicts for business and consumer lending clients
  • Primary drafter of motion in bankruptcy adversary proceeding preventing the sale of assets and protecting client’s interests
  • Successfully defended consumer lending client in motion for new trial proceeding in Harris County district court
  • Primary drafter in arbitration briefing for national client regarding contract disputes
  • Assisted in defending against non-compete and trade-secret dispute in Dallas County, defeating a temporary restraining order demand from plaintiff
