Janis Hui Ozaki is an attorney in the Business Litigation Department of Dykema's Los Angeles office. She is a member of the National Trial Team. She focuses on business and contract disputes, partnership disputes, fraud, and commercial real estate disputes.

Ms. Ozaki has successfully prosecuted and defended cases in state and federal courts and private arbitration. She listens to clients and develops intelligent and efficient litigation strategies to resolve legal and business problems. Her strengths include effectively communicating client narratives and legal arguments in brief writing and in the courtroom.

Ms. Ozaki works with clients from a broad array of industries, including but not limited to apparel, manufacturing, import-export, real estate, food and beverage, hospitality and entertainment.

Ms. Ozaki has been named to both the Southern California Super Lawyers® Rising Star and Top Women Attorney lists for Business Litigation every year since 2012.

Ms. Ozaki is a Lecturer at UCLA School of Law where she teaches legal research and writing. Ms. Ozaki speaks fluent Cantonese.

Experience

Business Contract Disputes

Ms. Ozaki has extensive experience litigating a variety of business and contract disputes. This includes but is not limited to purchase and sale agreements, service agreements, production agreements, manufacturing agreements, purchase orders, loan agreements, promissory notes, and lease agreements.

Partnership Disputes

Ms. Ozaki has successfully handled cases involving partnership, LLC, and joint venture disputes, including breaches of fiduciary duty and misappropriation of trade secrets.

Fraud

Ms. Ozaki has successfully litigated cases involving fraud, fraudulent misrepresentations, concealment, conspiracy, and embezzlement. She has successfully obtained punitive damages awards.

Commercial Real Estate Disputes

Ms. Ozaki has substantial experience litigating commercial real estate disputes, including those relating to lease agreements, purchase and sale agreements, foreclosures, evictions, escrow disputes, construction, receiverships, and general contractor and subcontractor disputes.

International

Ms. Ozaki regularly represents clients from Hong Kong and China in domestic litigation arising from business transactions in the U.S.

Obtained $2.2 million judgment including pre-judgment interest and punitive damages for breach of contract, goods sold and delivered, fraud, and conspiracy after a three-week federal court trial in the Southern District of New York

Obtained a favorable settlement of a federal ADA accessibility claim against an international hotel company

Obtained favorable settlement of employee discrimination and harassment claims on behalf of employer amounting to less than 2% of plaintiff’s demand

Obtained full recovery of damages for importing apparel company in negligence action against customs broker

Obtained six figure pre-judgment writ of attachment against individual and business in breach of contract action

Obtained dismissal with prejudice of federal lawsuit against mortgage company

Obtained dismissal with prejudice of lawsuit based on a vexatious litigant theory

Represented music manager in administrative hearing before the California Labor Commissioner on novel issue of whether management contracts with mixers are recording contracts exempt from the Talent Agency Act
