Luke Sosnicki is a commercial litigator in Dykema’s Los Angeles, California office. He has successfully litigated commercial contract disputes of all types, including claims involving breaches of warranty, breach of fiduciary duty, commercial landlord-tenant disputes, and trade-secret theft. He has also conducted internal investigations in response to allegations of corporate misconduct.

Mr. Sosnicki’s background is primarily in financial services litigation. He has extensive experience defending banks and mortgage servicers in individual and class action lawsuits across the country. He has successfully defended clients in lawsuits brought under various state and federal consumer protection statutes relating to loan origination, servicing, debt collection, foreclosure, as well as to unfair and deceptive practices generally. He is also an experienced appellate lawyer, having successfully represented numerous bank and servicer clients on appeal.

Mr. Sosnicki also maintains an active practice advising financial services companies on litigation and enforcement risks arising from federal and state laws governing data management, privacy, and eMortgage/digital mortgage processes, as well as on best practices for handling private consumer information. He also has a deep understanding of the new California Consumer Privacy Act (CCPA), which will take effect in 2020 and will allow consumers to demand that companies disclose what personal consumer information they have collected, how that information is used, and will also permit consumers to request that their private information not be sold.

Before joining Dykema, Mr. Sosnicki served as Vice President and Assistant Legal Counsel for Nationstar Mortgage, where he managed hundreds of lawsuits alleging various lending violations, origination fraud, and loan-servicing errors. Prior to joining Nationstar, Mr. Sosnicki was an Assistant General Counsel for Aurora Bank FSB (formerly Lehman Brothers Bank FSB), where he also managed litigation and advised various business units on litigation risk, foreclosure practices, and state and federal laws governing default management.

Mr. Sosnicki has a B.S. in Political Science and English from the University of Wisconsin, Madison. He obtained his J.D. from the Northwestern University School of Law, where he graduated cum laude and served as an Editor of the Northwestern University Law Review.
