Mark D. Jacobs' practice focuses primarily on environmental permitting, compliance and regulation, administrative law and regulation, environmental aspects of business transactions, and environmental litigation.
Prior to joining Dykema, Mr. Jacobs had many years of technical experience, working for an environmental consulting firm and a hazardous waste disposal and recycling company.
Experience
Mark Jacobs has a broad and diverse environmental practice consistent with the wide range of environmental needs presented by Dykema's expansive client base. He has significant experience in the following areas:
- Negotiating, allocating and resolving environmental risk in commercial and real estate transactions. Mr. Jacobs has been highly effective in advising a diverse base of clients on managing environmental risks in a wide range of transactional matters, from due diligence through closing, including large real estate transactions, financing and securities transactions (representing both lenders and borrowers), and asset, stock and merger transactions.
- Environmental permitting, compliance and enforcement. Consulting with both public and private sector clients on negotiating and obtaining permits under clean air, clean water (including wetlands), and solid and hazardous waste laws. Negotiating and resolving enforcement actions under most state and federal environmental laws, including landfill closures, clean air, clean water, hazardous waste and Occupational Safety and Health Administration (OSHA) law violations. He has established an excellent reputation and effective working relationship with environmental regulatory authorities, particularly in the State of Michigan and Region 5 EPA.
- Contaminated property cleanup, reuse and redevelopment. Representation has included assisting clients in achieving cost-effective risk based cleanups of environmentally impaired properties, developing property reuse strategies, and assisting clients in obtaining millions of dollars in state and local funding for brownfield redevelopment projects.
