Defect theories that begin in individual automotive product liability and consumer warranty litigation routinely find their way into class action litigation, but with a twist. The strict liability theories asserted in product litigation, and the warranty theories asserted in consumer litigation, become fraud claims in the class actions. Now, the process is starting to reverse; the consumer fraud claims are now being asserted in individual product and consumer cases.

The Supreme Court’s opinion on May 21, 2018 holding that requiring employment claims to be submitted to individualized (rather than class-based) arbitration is sparking a renewed interest among employers in mandatory arbitration for all employees. While mandatory arbitration does have advantages, there are disadvantages as well that should be carefully weighed by employers before deciding to jump on the arbitration bandwagon.

Each year, for the last several years, approximately 2 million workers in the United States claim to have experienced a workplace violence incident. The type of violence ranges from aggressive verbal behavior to active shooters. One FBI study cited 160 active shooting incidents that occurred from 2000 to 2013 with 80% happening in the workplace. The majority of the shooters were not employed with the company where the acts took place.

While California employers were busy keeping pace with changes that took effect in 2017, the California legislature were hard at work drafting and adding a number of new laws, many of which take effect in early 2018. Employers must now turn to the new year and begin preparing for the next set of employment laws poised to go into effect.

Since Dykema’s program one year ago, there have been major developments in federal and state legislation, regulation and policies for Highly-Automated Vehicles (HAV), including the all-new Department of Transportation HAV Policy 2.0, supplanting the one issued by the National Highway Traffic Safety Administration (NHTSA) under the Obama Administration. Moreover, federal legislation has been introduced in the United States Senate for HAV.
