Here Today, but not Tomorrow or the Next: Leaves of Absence

Leaves of absence issues have become one of the most complex issues confronted by employers. The scenarios almost always involve sensitive medical concerns and information, which results in emotional and sometimes irrational employees. The complexity is compounded by the myriad of legal guidelines related to the Americans with Disabilities Act (“ADA”), Family and Medical Leave Act (“FMLA”), workers compensation laws and even the Health Insurance Portability and Accountability Act (“HIPAA”). The Equal Employment Opportunity Commission (“EEOC”) has issued guidance related to the ADA and its relation to leaves of absence but as with most guidance, it is limited in scope and the examples are fairly basic. What should be a major concern to employers is the involvement of management employees who have no training about leaves of absence, which results in situations where FMLA notices are not sent timely or prohibited medical question are asked, or worse they take employment actions that appear to be or are actually retaliatory.  

This workshop is designed to briefly identify the legal considerations that should be considered when dealing with leave issues, discuss recent activity by government agencies, review cases involving mistakes other employers’ made that you want to avoid, and provide practical procedures for compliance with these requirements.
