Marsha G. Gentner, Washington, D.C.-based senior counsel in Dykema’s Intellectual Property Practice Group, authored the article, “Hazy Future for Federal Registration of Marijuana Marks,” which appears in Westlaw Journal Intellectual Property.

In the article, Gentner discusses how the U.S. Patent and Trademark Office is refusing registration of any trademark application that identifies marijuana or marijuana-related goods or services and its reasoning, highlighting relevant cases along the way. She later goes on to point out other avenues available for trademark registration.
