"The Continuing Evolution of the False Claims Act"

Jonathan Feld, Jason Ross, and Christina Brunty, attorneys in Dykema’s Business and Commercial Litigation Practice Groups are the authors of the Law Journal Newsletters/Business Crimes Bulletin article, “The Continuing Evolution of the False Claims Act.”

In their article on the increase in False Claims Act (FCA) litigation, the authors explain the impact of recent decisions and ongoing lawsuits involving whistleblower denunciations of schemes to defraud the federal government. Two examples of significant issues to be determined in the courts are 1) measuring the damages caused to the defendant when the plaintiff prematurely leaks information about a suit, and, 2) the validity of using statistical samplings from previous fraudulent claims when calculating monetary losses.
