A Practical Review of Thorny Discovery Issues

Deborah Williamson will serve as a featured speaker at the NAFER Annual Conference on September 7, 2023, in Nashville. Williamson’s session, “A Practical Review of Thorny Discovery Issues,” will provide an overview of common discovery questions, such as:

• • Who controls the attorney-client privilege?
  • Does the answer change if counsel was representing more than one party?
  • Has all potential evidence been preserved and does the Receiver have the ability to comply with discovery demands?
  • What are the consequences if such potential evidence hasn’t been preserved or the receiver can’t compel production?
  • What is required for a witness to properly assert the privilege against self-incrimination?
  • Does it make a difference if the statements are given informally?
