1. Wage and Hour Law
The Fair Labor Standards Act ("FLSA") remains one of the laws most commonly violated by employers and collective action claims (i.e. multiple plaintiffs in one lawsuit) are one of the most prevalent types of litigation across the country under this statute. The potential liability based on unpaid minimum wages, overtime, liquidated damages and attorneys’ fees may be extremely high when a number of individuals assert claims that may go back for a period of up to three years.
Walk away with greater knowledge on:
- Exempt v. non-exempt employees
- Record retention requirements
- Permissible deductions from exempt employees’ salaries
- How to calculate hourly employees' regular rate of pay (it is harder than you think)
- Prohibition against retaliation
2. Worksite Enforcement
Employers must be ready for increased immigration related enforcement efforts. U.S. Citizenship and Immigration Services has recently provided new tools to assist employers in their compliance efforts. Immigration and Customs Enforcement also continues to prosecute employers criminally in this area and employers must understand and appreciate this risk.
During the workshop we will discuss many topics including the following:
