As the Texas Business Court marked its first anniversary on September 1, 2025, Dykema is proud to be the most experienced law firm litigating in this innovative forum. Through the Court’s first calendar year, 176 cases have been filed statewide. Of those, six are currently being handled by Dykema—more than any other law firm.
The Texas Business Court was created to provide a streamlined, sophisticated venue for resolving complex commercial disputes, with jurisdiction over cases exceeding $10 million and a dedicated appellate court. In its inaugural year, the Court quickly became an important forum for high-stakes business litigation, drawing comparisons to the Delaware Court of Chancery.
Dykema’s matters in the Business Court involve issues at the heart of modern commercial litigation, including breach of contract, fraud in the inducement, theft of trade secrets, and disputes over finalized settlement agreements. In addition to handling the highest number of cases, Dykema has played a role in several notable “firsts.”
- Tim McCarthy and Cliff Riley argued the first-ever contested hearing before the Business Court in October 2024.
- Chris Kratovil became the first attorney to handle hearings in two different divisions of the Court on the same day.
Alongside the Dykema attorneys mentioned above, Tom Alleman and Matt Pepping have each appeared before the Court as well.
As the Court continues to evolve, Dykema remains committed to leveraging its experience to guide clients through this dynamic venue to resolve complex business disputes.
Following the Court’s anniversary, publications turned to Kratovil for insights gained from appearing before the Court. He was quoted in the following publications:
