The Use of Surveys When Registering, Enforcing, and Litigating Non-Traditional Marks

Jason Blair will serve as a featured speaker at the International Trademark Association (INTA) 2025 Annual Meeting, which takes place May 17-21 in San Diego. Presented by the 2024–2025 Non-Traditional Trademarks Committee, Blair and his session co-hosts will present “The Use of Surveys When Registering, Enforcing, and Litigating Non-Traditional Marks,” which will discuss the use of surveys in litigation involving non-traditional trademarks, including, among other things, questions relating to survey design in proving acquired distinctiveness, use of control groups, survey administration, identifying the appropriate sample population, and the use of survey experts.
