Two Dykema attorneys—Robert Horwitz, Detroit-based senior counsel in the Firm’s Financial Services Litigation practice; and Kathrin Kudner, Ann Arbor-based member in the Firm’s Health Care practice—were key presenters at an April 30, 2014 webinar, “Understanding How the Telephone Consumer Protection Act Affects Your Debt Collection Efforts.” This webinar was held under the auspices of the Healthcare Financial Management Association, a 40,000-member national organization of  healthcare financial management executives and leaders.

Horwitz, whose practice focuses  on debt collection, credit reporting and  telephone consumer protection act  (TCPA) compliance, regulatory and litigation matters, discussed the current state of the TCPA, including consent and auto-dialer issues, unique aspects of the act as applied to healthcare providers and offered best practices to comply with the act. 

Kudner, whose practice is devoted to the representation of health care providers and payors, spoke about the new requirements imposed on tax exempt hospitals under Section 501(r). Kudner explained the obligations imposed on hospitals by the Patient Protection and Affordable Care Act, including conducting a community health needs assessment, adopting policies for financial assistance, emergency care, and billing and collection, limitations on charges and new reporting and disclosure requirements.
