James Azadian Discusses California Law Exonerating Unions for Non-Member Fee Levies in the Los Angeles Daily Journal

James S. Azadian, Los Angeles-based member in Dykema’s Commercial Litigation Practice Group and the firm’s nationwide appellate practice, was quoted at length in the Los Angeles Daily Journal article, “New State Law to Protect Unions Faces Legal Challenges.” 

Following the 2018 U.S. Supreme Court decision rectifying the unconstitutionality of the historical practice of charging reduced fees to non-union workers in union shops, California enacted a law exculpating unions who assessed the fees prior to the High Court opinion. Azadian points out the weakness of the state law should it be challenged in Federal court, given that U.S. constitutional rights prevail over state laws.
