Jonathan S. Feld, Chicago-based member in the Litigation Department, whose practice focuses on complex civil and criminal matters and internal investigations, authored an article—“Corporate Cooperation: What it Now Means for Companies and Employees”—that appears in the January 2015 Business Crime Bulletin.

In the article, Feld covers a number of recent penalties imposed by the U.S. Department of Justice (DOJ) and discusses how despite these results, the DOJ has been criticized for a lack of individual prosecutions, particularly in the financial sector. Recent speeches from senior DOJ officials show a renewed emphasis on the prosecution of individuals responsible for corporate misconduct.

According to Feld, these speeches are a signal to corporate counsel to stress the importance of, and actions needed for, corporate cooperation and self-disclosure.
