David Graham Authors Article on State Law Product Liability Claims for For The Defense

David P. Graham, Minneapolis-based senior counsel in Dykema’s Products Liability and Professional Liability Practice group, and leader of the Firm’s Food & Beverage Practice Group, authored the article “State Law Product Liability Claims and Federal Question Jurisdiction,” which appeared in the DRI’s publication For The Defense.

In the article, Graham points out that when a plaintiff’s case is solely focused on whether a product manufacturer complied with federal law and regulations and whether or not a removal of a state court action may be appropriate. Graham goes on to discuss how regulatory history matters and the federal nature of the plaintiff’s allegations.
