Cale A. Johnson, Bloomfield Hills-based member of Dykema’s Business Litigation Practice Group, was quoted in the FTC Watch article, “Veteran antitrust lawyers: New guidance on DOJ leniency program creates uncertainty.”

The article discusses how experienced antitrust practitioners disagree with sentiment from a senior antitrust official in the Justice Department that recently issued guidance about the division’s leniency program breaks no new ground.

Johnson points out that under the revised language certain employees can now be prosecuted by the government who were effectively protected from prosecution previously. He then goes on to highlight how the language within creates uncertainty as to how the policy is going to be enacted.
