Kathrin E. Kudner, an Ann Arbor-based member in Dykema’s Health Care Practice Group, was quoted in a Law360 article—“3 Pitfalls to Avoid as ACA Sunshine Act Takes Effect”—that appears in July 31, 2013 issue of this online news source.

In the article, Kudner—who represents health care providers and payors in various corporate and regulatory matters—observes that, with drug and medical device companies now needing to disclose most payments to doctors and teaching hospitals under a mandate of the Affordable Care Act, manufacturers need to be exceptionally vigilant in tracking and recording not just cash payments but other items of value.

Acknowledging the low threshold for reporting ($10 for single actions and smaller payments that add up to $100 in a single year), Kudner notes that smart manufacturers are erring on the side of tracking “virtually every dollar. They’re taking a conservative, over-inclusive approach,” she reports.
