Marty Truss Quoted in Law360 Article

James M. (Marty) Truss, San Antonio-based member and co-leader of Dykema’s Energy Industry Group, was quoted in the Law360 article, “5 Things You Should Never Do For A Client.”

In the article, Truss discusses the ethical problem and disadvantages associated with filing a lawsuit or asserting claims without a genuine intention to prosecute. He points out that a hollow lawsuit forces the adversary to file applicable counterclaims, even if they originally never planned on taking the dispute into litigation—which of course also drastically increases costs.

Furthermore, Truss also highlights that parties who employ this strategy regularly run the risk of not being taken seriously when threatening litigation in the future.
