Dykema Attorneys to Host Ethics Presentation on Attorney-Client Privilege for In-House Corporate Counsel

William B. Finkelstein, an attorney in Dykema’s Corporate Finance and Bankruptcy Practice Groups, and Office Managing Member in the Firm’s Dallas office, Edwin J. Tomko and Jason M. Ross, Dallas-based attorneys in the Firm’s Business Litigation Practice Group, will serve as co-presenters, of the panel discussion “Attorney/Client Privilege for In-House Counsel,” in Dykema’s Dallas Office on Thursday, July 17, 2014, at 5:30 p.m. The event will also be co-sponsored by ParenteBeard.

Finkelstein and Ross will serve as panelists, along with Robert Gray, a partner at ParenteBeard, and Tomko will moderate the 60-minute discussion. The presentation will discuss:

  • waiver of privilege
  • the work product doctrine
  • the crime fraud exception
  • legal versus business advice
  • privilege in an M&A transaction

The panel discussion is accredited with 1-Hour Ethics MCLE Credit and will be followed by a cocktail reception.

Finkelstein’s nearly 40-year practice focuses on providing general business and strategic advice to clients in a broad spectrum of industries, including manufacturing, metals recycling, jewelry, retail, medical-dental equipment and real estate. He has also represented companies, investors and financial institutions in various commercial litigation, restructuring and insolvency matters, and commercial transactions.

Tomko concentrates his practice on federal and state white collar crime cases involving government contracts, financial institutions, securities, environmental and health care issues. He has handled federal civil cases such as qui tam and other False Claims Act actions and breach of contract suits involving fraud or breach of contract allegations. Before joining Dykema, Tomko held various positions with the Department of Justice and the Securities and Exchange Commission.

Ross focuses his practice on complex litigation, with an emphasis on white collar criminal defense and securities law. He has counseled clients in a variety of governmental proceedings brought by agencies such as the Department of Justice, the Securities and Exchange Commission, Federal Bureau of Investigation, the Environmental Protection Agency, the Department of Labor and the Federal Trade Commission.
