Cinthia Granados Motley is the Director of Dykema’s Global Data Privacy and Information Security practice group. She has an active national and international practice assisting clients implement effective information security practices, address current and emerging regulatory compliance issues, including cross-border data transfer and information governance, as well as litigation readiness and regulatory inquiry matters. She routinely acts as incident response counsel to national and multi-national entities, as well as privacy litigation counsel. In her litigation practice, Cinthia handles consumer and privacy litigation, international contract disputes, directors and officers liability, ERISA, e-discovery and professional liability matters. She routinely counsels clients in complex commercial disputes both domestically and abroad.
Cinthia has a natural ability to connect with clients and quickly identify their needs. She uses this strength to develop and maintain strong, effective communications with them throughout all legal matters, from incident response through the litigation cycle. She is also known for her presence in the courtroom, which showcases her natural ability to communicate and connect with others. This natural leadership has earned Cinthia the respect of clients and colleagues, as well as judges and adversaries.
A compelling litigator, Cinthia has represented clients in appellate matters before the Seventh, Eighth and Ninth Circuits and before the United States Supreme Court. She has handled litigation matters in across the country, including Illinois, Wisconsin, Indiana, Michigan, Minnesota, Missouri, Ohio, Iowa, California, South Carolina and Florida, as well as before the American Arbitration Association.
Experience
Data Privacy and Security
Cybersecurity presents an extraordinary threat to our national and international security and can impact our foreign policy and the worldwide economy. Cinthia represents clients in data security and privacy litigation and understands the importance of a complete cybersecurity program. She has developed a comprehensive service for clients to manage this process from pre-event to post-event. She routinely acts as incident response counsel to large national and international entities, advising them on information governance and litigation readiness, as well as mitigating cyber risks exposures, data security and privacy litigation.
In particular, she has handled class action lawsuits brought under state or federal consumer and privacy laws. Cinthia has successfully led defense and e-discovery teams in obtaining favorable early case resolutions of complex multimillion-dollar lawsuits.
Pre-event services include: data breach coaching; information management and litigation readiness; developing and testing incident response plans and privacy policies; regulatory compliance readiness and analysis; third-party management and vendor agreements; and C-suite, board, executive level and employee training.
Post-event services include: national and international breach response and coordinating counsel; security incident containment; managing regulatory compliance and investigations; remediation; and post-event lessons-learned analysis. Cinthia has worked with companies in a wide variety of industries including: financial services; health care; education; retail; hospitality; transportation; and companies insured by leading insurance firms.
E-Discovery and Information Governance
Cinthia worked at the Seventh Circuit Court of Appeals before joining Dykema and has been an active member of the Seventh Circuit e-Discovery Pilot Program Committee since 2009. She is also a panel e-mediator for the Committee’s E-Mediation Program. Keeping pace with the growing importance of electronic data, the mission of the committee is to develop pre-trial litigation principles governing electronic discovery to reduce its cost and burden, so that prohibitive costs do not influence clients’ litigation decisions. Cinthia is a frequent speaker on e-discovery matters and serves as an adjunct professor of law in this area.
ERISA
Cinthia has a strong background in successfully defending life, health and disability claims brought against plan and claim administrators and managed-care organizations. She has provided counsel to employee benefit plan administrators and fiduciaries concerning ERISA, employee benefits and health care issues.
Latin America and Commercial Litigation
Cinthia is a native of Honduras and currently acts as coordinating counsel for clients in matters in Latin America. Drawing on her bilingual and multicultural skills, she has represented international companies in multijurisdictional and complex litigations. In her commercial litigation practice, she has represented clients in various jurisdictions and in arbitration proceedings before the American Arbitration Association. She has defended a wide range of contract, statutory and tort-based claims on behalf of corporate clients and their directors and officers.
