Thomas Sanders, a Member in Dykema's San Antonio office serves as the Practice Group Leader for Commercial Litigation. Mr. Sanders primarily represents insurance companies in coverage disputes and high-exposure bad faith cases arising from catastrophic weather events. Thomas also represents Employee Welfare Benefit Plans, third-party administrators and employers in ERISA litigation and he counsels clients regarding litigation and risk mitigation associated with their pension, ESOPs and health and welfare plans. 

Experience

Insurance Litigation

  • Large-exposure bad faith claims. Represented property and casualty insurers in hundreds of hurricane, wind and hail, mold exposure and foundation claims; life insurers in large death claims; and health/disability insurers in claims involving the denial of large medical and disability claims
  • Coverage disputes. Represented insurers and insureds in coverage disputes involving property and casualty, life and ADD, and professional liability policies
  • Class actions. Represented insurers in class actions involving alleged misrepresentation/omissions of premium charges and service charges for life insurance products
  • Fraud. Prosecuted numerous claims for alleged premium fraud in workers compensation programs
  • Technology risk insurance. Represented London market insurers in coverage disputes involving technology risk insurance
  • Securities fraud. Represented insurers and affiliated broker/dealers in securities fraud claims based on alleged misrepresentations in sales of insurance products and securities

ERISA Litigation

  • Improper claims handling. Represented insurers, plans and third-party administrators in numerous lawsuits involving alleged improper claims handling, improper denial of benefits, breach of fiduciary duty, and discrimination claims under ERISA
  • Class actions. Represented insurers in ERISA class action lawsuits involving alleged improper calculation of lump sum disability benefits and alleged improper offsets of other income benefits

Reinsurance Litigation

  • Represented ceding companies in arbitrations arising under reinsurance treaties covering “impaired” risk life policies
  • Represented London market insurers and reinsurers in coverage litigation involving law firms and accounting firms in tax shelter litigation

Commercial Litigation

  • Dispute over sales commissions. Represented insurers in arbitration involving dispute over commissions due under marketing agreement for sale of investments in qualified plans
  • Trade secrets. Represented companies in lawsuits involving unfair competition and theft of trade secrets by former employees
  • False advertising. Represented geosynthetics manufacturer and drug manufacturers in unfair competition and Lanham Act false advertising claims
  • Design and construction defects alleged. Represented company in lawsuit involving alleged design and construction defects of large warehouse facility; represented homebuilder in numerous alleged construction defect lawsuits
  • Warranty and deceptive trade practices claims. Represented truck retailer in warranty and DTPA claims throughout the United States
  • Severance tax class action. Represented oil and gas operators in nationwide severance tax class action
  • Drilling damage litigation. Represented oil and gas companies in mass property damage claims associated with drilling activities
  • Regulatory compliance and internal investigations. Represented companies on regulatory compliance, regulatory investigations and internal investigations
