Nothing Has Changed, but Nothing is the Same
Though there has been little or no legislative activity in recent years specifically affecting employers, it has not stopped administrative agencies from challenging employers by aggressively enforcing existing laws and “reinterpreting” old regulations. This includes the Equal Employment Opportunity Commission’s issuing guidance on arrests and convictions that, while not game changing, emphasized the new focus of the agency’s efforts: to challenge how employers make employment decisions. The National Labor Relations Board, with its implementation of new regulations and newfound interpretations under the National Labor Relations Act, remains the most dramatic actor. However, the U.S. Supreme Court has issued two new rulings that are viewed as positive for employers.
