The Fair Labor Standards Act ("FLSA") remains one of the laws most commonly violated by employers, and collective action claims (i.e. multiple plaintiffs in one lawsuit) are one of the most prevalent types of litigation across the country under this statute. The potential liability based on unpaid minimum wages, overtime, liquidated damages and attorneys’ fees may be extremely high when a number of individuals assert claims that may go back for a period of up to three years.
