Dykema’s Fredrick S. Levin, a complex commercial litigator and member in the Firm’s Detroit office, was interviewed by Smart Business Detroit for the publication’s October 2012 article, “Multiple fronts: How to prepare for and handle multi-jurisdictional litigation.” The article discusses the challenges presented in multi-jurisdictional litigation, and the strategies a legal team may employ to ensure an efficient and successful result for the client.

Levin comments that litigation in multiple jurisdictions involving multiple similar issues, “can lead to duplication of expenses and the risk of inconsistent verdicts...” He cautions that while a litigation may seem “routine” in nature, the fact that multi-jurisdictional claims exist can lead to non-routine handling of the matter. The article goes on to state that “the key to effective defense is an early and thorough diagnosis of the problem,” citing such considerations as determining whether facts or practices are easily explained or defended, or whether the cost of litigation poses a greater threat than the claims themselves.

Levin goes on to further dissect particular issues that can impact multi-jurisdictional claims and concludes with suggesting a few action items that lead counsel should consider in taking on a multi-jurisdictional matter.
