Bankruptcy cases involving commercial real estate present a multitude of problems. Those problems typically arise in the context of voluntary cases filed under Chapter 11 of the Bankruptcy Code (Code), 11 U.S.C. §101, et seq., and involve a dispute between the business debtor and its mortgage lender. This chapter will (a) identify the problems that occur most often in voluntary, Chapter 11 cases involving commercial real estate and (b) describe the current state of the law that applies to those problems.
