Professional Liability Insurance
Dykema’s full-service professional liability team is at the forefront of coverage issues, providing insurance company clients with counseling and litigation services on complex professional liability matters nationwide. Chambers USA: America’s Leading Lawyers for Business recognizes our team for its “dedicated representation of insurers in complex coverage disputes” and “strong record” in professional liability matters.
Dykema played a leading role in the 2021 Professional Liability Underwriting Society (PLUS) Conference, which took place Nov. 8-10, 2021 in Dallas, Texas. Tom Judge served on the planning committee for the event, which was also sponsored by the firm.
We represent insurers in connection with claims against bankers, investment advisors and managers, lawyers, accountants, business and computer consultants, architects, engineers, surveyors, real estate agents, insurers, insurance agents, title agents, healthcare organizations, medical facilities, health professionals, and others.
We advise insurers regarding all aspects of their professional liability programs, including:
- Evaluating coverage issues and advising on coverage determinations. Dykema’s E&O team routinely drafts coverage analyses, reports, and opinions, and prepares coverage correspondence.
- Devising and implementing claim resolution strategies to effectively and efficiently resolve claims.
- Resolving claims through alternative dispute resolution, including mediation, arbitration, negotiation, and policy buyouts.
- Monitoring underlying litigation and analyzing and assessing liability and exposure issues.
- Representing clients in bringing and defending coverage actions. We have litigated virtually every major issue including rescission, notice and reporting issues, related claims questions, the scope of professional services covered, retroactive dates, application-based limitations, and other policy provisions.
- Assisting clients in drafting professional liability policy forms and endorsements.
