Gary Gordon, Lansing-based member in Dykema’s Government Policy practice, was quoted in the Detroit News article, “State board approves petition language to ban drilling.” The article covers the Michigan Board of State Canvassers’ approval of petition format for a ballot campaign to ban hydraulic fracturing (fracking).

Gordon weighed in, stating that the petition’s title language was deceptive, misleading and doesn’t meet minimal statutory and constitutional requirements. He also stated that the proposal would dramatically reduce revenue from state oil and gas leases used to fund public land purchases and park improvements.

Gordon also pointed out that the proposal also clashes with legal provisions that give the state’s Court of Claims the authority to settle legal disputes over such issues as fracking practices.
