The last two years have produced a dizzying array of governmental activity amongst the world of employment law.  The changes have exploded for political, societal, and biological reasons, to name a few. Join us for an in-person presentation in Dykema’s San Antonio office exploring hot topics in the current state of employment law.

Covid will continue to be a driving force of change and adaption in the workplace.  This session will review the unique state of affairs around vaccines, CDC guidelines, OSHA enforcement and remote work. 

The Department of Labor, Wage and Hour division is aggressively enforcing current law, regulations, and opinion letters, if nothing else.  As usual, there is something else going on within the DOL.  This includes focusing on independent contractor status, exempt v. non-exempt misclassification issues, amending the white collar regulations (can you say “an increase in the guaranteed weekly salary”) and a much desired, by some, increase in the minimum wage.  Civil monetary penalties and liquidated damages have returned to the DOL platform of enforcement.

The program also will contemplate the need to review and update handbooks as the National Labor Relations Board has a clearly stated agenda to reverse many guiding decisions from recent years, related to confidentiality, investigations and joint employment.

Though very recently decided, the session will attempt to predict the possible outcomes of the Dobbs Supreme Court decision on abortion and its potential impact on organizations.
