On Thursday, June 13, 2013, Alex W. Craigie, a member in the Labor & Employment practice in Dykema’s Los Angeles Office, will provide insight into “Independent Contractor Compliance and Risk Mitigation Strategies” in a 75-minute presentation to the Santa Clarita branch of the Professionals in Human Resources Association (PIHRA). This event will be held at the Paseo Club of Valencia.

Misclassification of workers as independent contractors is among the most serious problems facing employers today. Whether such misclassification results from benign neglect or purposeful “gaming the system” to avoid obligations that result from the employment relationship, the potential consequences can be severe.

In an interactive format that promises to be as engaging as it is informative, Craigie will provide employers with tools and techniques to lessen the chances of being targeted for an administrative action or a costly lawsuit. Attendees will learn such important lessons as:

  • Why employers are tempted to improperly classify workers as independent contractors rather than employees
  • The penalties for wrongful classification
  • How and why a person can be properly classified as an independent contractor (i.e. the test)
  • Some hypothetical examples to help ensure understanding of how the test is applied
  • What employers should do when they recognize they have workers who are presently misclassified as independent contractors
