Arlene Switzer Steinfield, Dallas-based senior counsel in Dykema’s Labor and Employment Practice, and Andrew D. Peters, a Minneapolis-based attorney in the firm’s Business Litigation Group, co-authored an article—“When Your Employee Is Your Adversary: Dealing With Employees Who Are Suing Your Company”—that appeared in Corporate Counsel.   

In the article, Steinfield and Peters discuss the challenging circumstances employers may face when an employee sues for discrimination, harassment, or retaliation and continues to work for the company. The article provides practical tips for managing and disciplining employees who have engaged in protected activity, and striking a balance between an employee’s right to bring a discrimination claim against the employer’s prerogative to manage its business without the interference of the courts. These guidelines include ways to coach managers who supervise the employee, effective documentation of misconduct and performance problems, the proper timing of disciplinary action, and when termination is a reasonable option.
