Robert A. Boonin, Detroit- and Ann Arbor–based member in Dykema’s Labor & Employment Practice Group and former chair of the Wage and Hour Defense Institute, was quoted in the Bloomberg Law article, “New Rule Boosts Worker Perks Without Impacting Overtime (1).” The new rule is scheduled to take effect January 15, 2020.

This Rule purportedly allows employers to provide more employee benefits such as wellness programs, payments for unused leave, reimbursed expenses for cellphone plans, and more, without including their monetary value in a worker’s regular hourly rate which Boonin states will give businesses “a lot more comfort” but “it’s not going to alter the rotation of the earth in any respect.”
