Robert A. Boonin, Detroit and Ann Arbor–based member in Dykema’s Labor & Employment Practice Group, and former chair of the Wage and Hour Defense Institute, was quoted at length in the Crain’s Detroit Business article, “Overtime Limbo: Court Case Over Proposed Eligibility Rule Change Remains Unresolved.”

Commenting on the stalled regulation, Boonin believes that until a permanent Solicitor of the Department of Labor is nominated by the new administration, the court case challenging the rule change is unlikely to proceed; and he predicts that employers cannot expect a prompt resolution to the impasse, given that the overtime salary issue is not a priority for the new president.
