Minneapolis-based attorneys Shannon M. Heim, Senior Counsel in Dykema’s Government Policy and Regulated Industries groups, and Erik B. Levy, an attorney in the firm’s Business Services Group, authored the article, “FCC Liability Lurks for Unwary in Mergers and Acquisitions,” which appears in the February 2015 issue of Metropolitan Corporate Counsel, a monthly publication distributed to nearly 20,000 top-tier executives (chief legal officers, genera; counsel, in the law departments of major U.S. companies.

In the article, Heim and Levy highlight how non-telecommunications businesses increasingly rely on telecommunications technologies, many of which are subject to Federal Communications Commission (FCC) licenses. The authors point out that the FCC licenses associated with internal communications are easily overlooked in the process of merging or acquiring assets and businesses and discuss the many factors companies should keep in mind to protect themselves.
