Arlene Switzer Steinfield, Dallas-based senior counsel in Dykema’s Labor and Employment Practice, was quoted in the Society for Human Resource Management (SHRM) article, “EEOC Enters First Settlement in Sexual Orientation Case,” which covers the Equal Employment Opportunity Commission’s (EEOC) settlement in a lawsuit regarding allegations that sexual orientation discrimination violates Title VII.

Steinfield highlights that the far-reaching settlement indicates that the EEOC is taking an aggressive stance in broadening the judicial interpretation of discrimination because of sex to prohibit discrimination on the basis of sexual orientation. She also shared her belief that courts will be receptive to this interpretation, but only if the alleged discrimination can be tied to sexual stereotyping in the workplace. Steinfield also offered additional commentary about the settlement in regards to this particular case.
