With experience as uniquely creative and innovative as it is extensive and deep, Jason Blair works closely with clients to build their brands, secure their intellectual property portfolios, and navigate their most challenging and novel trademark, trade dress, and copyright issues.  

Handling every aspect and stage of the domestic and international registration lifecycle, from searches and clearance to applications and responses to office actions and other potential impediments, Jason joined Dykema after seven years of private intellectual property practice and over a decade serving as an examining attorney for the U.S. Patent and Trademark Office (USPTO). As very few examiners at the USPTO leave for private practice after such an extended tenure, Jason is in a unique position to provide invaluable insights into the trademark prosecution and registration process for the benefit of his private sector clients. Unlike others, however, Jason was called upon to do far more than examine and manage applications or handle other routine matters.

In addition to being directly involved in the prosecution and examination of over 15,000 trademark applications, Jason essentially wrote the book on sound and motion marks, developing from scratch the framework, standards, and policies that now govern these unique IP assets.

Named the USPTO's Special Marks Examiner for Sound and Motion Marks in 2008, Jason was not only charged with examining all sound and motion mark applications, he drafted several provisions of the Trademark Manual of Examining Procedure (TMEP) dealing with such marks, was directly involved in formulating sound and motion mark policies, and worked with foreign government officials to harmonize sound and motion mark practices globally.

Those efforts speak not only to Jason's relentless work ethic but also his ability to bring clarity to complexity and his inclination to take on the most complex intellectual property challenges. His work is informed not only by his legal experience and acumen but also by his background as a professional musician, producer, and promoter. This experience gave Jason invaluable, real-world perspectives on brand development and marketing strategies and facilitates his ability to seamlessly collaborate with his clients' creative professionals just as effectively as with their C-suite executives and in-house legal teams.

Intellectual property is inherently creative, unique, and dynamic, such that it sometimes doesn't fit neatly into existing legal constructs. In such cases, I truly enjoy finding a path that allows clients to avail themselves of the law's protections and reap the benefits of their efforts.
